These Terms of Use are entered into by and between You and Romanian United Fund ("RUF," the "Corporation," "we," "us," or "our"), a charitable not-for-profit corporation incorporated in the state of Illinois, United States, and described as a public charity under section 501(c)(3) of the United States Internal Revenue Code. "Global Romania" is an initiative of RUF, operating under RUF's legal umbrella.
The following terms and conditions, together with any documents they expressly incorporate by reference (collectively, "Terms of Use") govern your access to the "Global Romania" website at https://www.globalromania.org/ (the "Website"), including any content, functionality, and services (collectively "Services") offered on or through the Website, and includes your use of RUF materials, programs, and brand, whether as a guest or a registered user.
Please read these Terms of Use carefully before you start to use the Website. By accessing or using the Website, you accept and agree to be bound and abide by these Terms of Use and our Privacy Policy, found here, incorporated herein by reference. If you do not want to agree to these Terms of Use or the Privacy Policy, you must not access or use the Website.
Use of the Website and application for membership are permitted for individuals who meet the following minimum age requirements based on their location: at least 14 years old, for users accessing the Website from the United States; or at least 16 years old, for users accessing the Website from the European Union. By using the Website or submitting a membership application, you confirm that you meet the applicable age requirement for your location. Membership in Global Romania is by invitation and application. The Website does not host an application form. Membership requests are made by contacting a local point of contact (PPOC) listed on the Website or by emailing hello@globalromania.org. The membership community operates on a separate platform at community.globalromania.org, which may be governed by additional terms.
RUF reserves the right to approve, reject, or revoke, at its reasonable discretion, any application or membership status, including in cases involving the submission of inaccurate information or a violation of these Terms of Use.
5.1. You may use the Website only for lawful purposes and in accordance with these Terms of Use. You agree not to use the Website:
In any way that violates any applicable federal, state, local, or international law or regulation (including, without limitation, any laws regarding the export of data or software to and from the US or other countries).
For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content, asking for personally identifiable information, or otherwise.
To transmit, or procure the sending of, any advertising or promotional material without our prior written consent, including any "junk mail," "chain letter," "spam," or any other similar solicitation.
To impersonate or attempt to impersonate the Corporation, a Corporation employee, another user, or any other person or entity (including, without limitation, by using email addresses or screen names associated with any of the foregoing).
To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Website, or which, as determined by us, may harm the Corporation or users of the Website, or expose them to liability.

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL THE COLLECTIVE LIABILITY OF THE CORPORATION AND ITS SUBSIDIARIES AND AFFILIATES, AND THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, AND DIRECTORS, TO ANY PARTY (REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT, OR OTHERWISE) EXCEED THE AMOUNT YOU HAVE PAID TO THE CORPORATION FOR THE APPLICABLE CONTENT OR PRODUCT OR SERVICE IN THE LAST SIX (6) MONTHS OUT OF WHICH LIABILITY AROSE.
These Terms are governed by and construed in accordance with the laws of the State of Illinois, United States of America, without regard to its conflict of laws principles. Any dispute arising out of or in connection with these Terms will be resolved by the competent courts of the State of Illinois.
Notwithstanding the foregoing, nothing in this clause affects the rights that users located in the European Union may have under the General Data Protection Regulation (EU) 2016/679 ("GDPR") and Directive 2002/58/EC (the "ePrivacy Directive") with respect to the processing of their personal data and the use of cookies, which remain applicable regardless of the governing law chosen above.
